Terms of Service

These Terms of Service ("Terms") govern your access to and use of Active Affair (the "Service"), including the public event pages, volunteer and donor tools, and the organization administration tools. By signing up for an event, creating an organization, or otherwise using the Service, you agree to these Terms.

1. Who We Are

Active Affair is owned and operated by GigGame (www.giggamestudios.com), a qualified subchapter S subsidiary ("QSub") of Spark Innovations Corp, a corporation organized under the laws of the State of Florida and headquartered in Orlando, Florida. In these Terms, "GigGame," "we," "us," and "our" refer to GigGame and Spark Innovations Corp together.

2. What Active Affair Does

Active Affair is a volunteer-signup, fundraising, and lightweight CRM platform used by schools, nonprofits, and companies ("Organizations") to run events. Depending on how an Organization configures an event, the Service may offer volunteer signups with slots and waitlists, custom signup questions, potluck coordination, paid or free registration, team and individual fundraising pages, donations, sponsorships, a public event directory and organization profile, email messaging (including AI-assisted drafting) to an Organization's own contacts, scheduled reminders, rosters, reports, and photo/document uploads.

3. Accounts and Eligibility

You must be at least 18 years old to create an Organization account. Volunteering, registering, donating, or sponsoring through a public event page does not require creating an account — those flows work through a one-time signup and a private management link sent by email. If an event is intended for participants under 18 (common for school events), we expect the responsible Organization and/or a parent or guardian to be the one submitting or supervising the submission of that information, and the Organization is responsible for complying with any applicable laws about collecting information from minors in that context.

Organization owners are responsible for everything that happens under their Organization's account, including the actions of any administrators they invite. Keep your login credentials confidential and notify us promptly at support@gig.game if you suspect unauthorized access.

4. Payments

Donations, registrations, and sponsorships. When a volunteer, donor, sponsor, or registrant pays an Organization through Active Affair, that payment is made directly to the Organization's own PayPal account via a link the Organization provides (either a PayPal.me link or a classic PayPal email address). Active Affair never receives, processes, stores, or has access to any of that payment or the payer's payment information. Whether a payment shows as "confirmed" inside Active Affair depends on what PayPal tells us when the payer returns from PayPal — this is a convenience indicator only, not a financial guarantee, and Organizations are solely responsible for reconciling actual receipt of funds directly with their own PayPal account.

Paid email sending. Composing and previewing messages, using the AI writing assistant, and sending test emails to yourself are free. Actually sending a message to your contacts — whether a single email or a bulk campaign — is billed to the Organization at the per-recipient rate shown at the time of sending, charged to the payment card on file before the message goes out. You will always see the exact recipient count and total charge before confirming a send. This charge is for the send attempt itself, not a guarantee of delivery — recipients who have unsubscribed or been suppressed are excluded from the recipient count and never billed, but once a message is actually sent to an eligible recipient, the charge is final and non-refundable even if that individual copy bounces, is filtered as spam, or otherwise fails to arrive, since the underlying delivery cost is incurred regardless of outcome. All such charges are final and non-refundable, except where required by law. Pricing may change on notice through the Service.

5. Your Content

Organizations and volunteers may upload content to the Service, including organization logos and cover photos, event header and gallery photos, and volunteer-uploaded receipt images or PDFs ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display it as necessary to operate the Service. You are responsible for having the rights to anything you upload, and for not uploading anything unlawful, infringing, or containing sensitive information (such as full payment card numbers) that doesn't belong there. Uploaded photos and gallery images are served from a public content-delivery URL and are not access-restricted once uploaded — don't upload anything you don't want to be publicly reachable by anyone with the link.

6. Acceptable Use

You agree not to use the Service to: send spam or unsolicited bulk email unrelated to a legitimate event or organizational purpose; collect information from participants for any purpose other than the event they signed up for; misrepresent an Organization's identity or purpose, including running fraudulent fundraising; attempt to access another Organization's data without authorization; upload malicious files; or interfere with or attempt to circumvent the Service's security, rate limits, or payment mechanisms.

7. Third-Party Services

The Service relies on third-party providers to operate, including payment processing (Authorize.Net, for the paid email-sending feature only), email delivery, AI-assisted writing suggestions, file storage/content delivery, database hosting, and address geocoding for maps. Your use of PayPal for donations, registrations, and sponsorships is governed entirely by your own agreement with PayPal — we are not a party to it. We are not responsible for the acts, omissions, or availability of any third-party service.

8. Intellectual Property

The Active Affair name, logo, design, and underlying software are owned by GigGame and Spark Innovations Corp and may not be copied, reproduced, or used without our written permission, apart from an Organization's ordinary use of the Service as intended.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any confirmation status (payment, email delivery, etc.) shown in the Service is perfectly accurate.

10. Limitation of Liability

To the fullest extent permitted by law, GigGame and Spark Innovations Corp will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, donations, data, or goodwill, arising from your use of the Service — including any dispute over a payment made directly between a payer and an Organization via PayPal. Our total liability for any claim relating to the Service will not exceed the amount you paid us (if any) in the twelve months before the claim arose.

11. Indemnification

You agree to indemnify and hold GigGame and Spark Innovations Corp harmless from any claim arising out of your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate access to the Service for any account that violates these Terms. You may stop using the Service, or ask us to delete your Organization's account, at any time by contacting support@gig.game.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Service after a change means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Orange County, Florida.
